Your agreement with us

These terms form an agreement between you and FitCheck Duo when you create or use a FitCheck Duo account. Please read them with our Privacy Policy and Fitness & AI Disclaimer.

By creating an account, requesting a paid membership or continuing to use FitCheck Duo after being told about an important update, you agree to follow these terms. If you do not agree, do not use the service.

Eligibility

You must be at least 16 years old to create an account. You must provide accurate information and have legal capacity to enter into this agreement.

FitCheck Duo is currently intended for personal, non-commercial fitness and wellbeing use in the United Kingdom unless we agree otherwise in writing.

Your account and security

• Where you use a password, keep it confidential and use one that you do not reuse elsewhere. Where you use Google sign-in, keep your Google account secure.
• Do not share your account or allow another person to use your AI allowance.
• Keep your email address and profile information reasonably up to date.
• Tell us promptly if you think your account or connected service has been compromised.
• You are responsible for activity performed through your account unless it resulted from our failure to use reasonable care.

Payments, renewals, cancellation and refunds

• Request-only coaching access does not create a payment or recurring subscription.
• Automatic Stripe subscriptions will only apply after the administrator launches billing and you actively complete a Stripe checkout.
• The price, renewal date and cancellation method are shown before you subscribe and remain available in Membership & billing.
• You can update payment details, switch eligible plans, view invoices or cancel through the Stripe customer portal opened from FitCheck Settings. Cancellation normally takes effect at the end of the current paid period unless Stripe confirms otherwise.
• We will not increase an active recurring price without giving reasonable advance notice and explaining when the new price applies.
• Refunds and cooling-off rights are handled in accordance with applicable consumer law and the information supplied at purchase.

AI allowances and fair use

Paid memberships include an AI usage allowance rather than unlimited generation. Different actions use different amounts because long responses, image analysis, audio, video and advanced models have different processing costs.

• Your current allowance, usage and reset date are shown in FitCheck where available.
• Chat message limits and estimated-cost limits may both apply.
• Unused allowance does not roll over unless we expressly say that it does.
• We may temporarily delay or refuse unusually high, automated, abusive or technically unsafe usage.
• We may adjust future allowances to reflect model pricing or service changes, but will make material changes clear before they affect a paid renewal.

AI-assisted and human-coach workspaces

Tim is an AI-assisted coaching feature. Responses may use information in your account, including goals, check-ins, photos, plans, food preferences and connected wearable data.

• AI responses can be incomplete, inaccurate or unsuitable for your individual circumstances.
• Tim does not provide medical diagnosis, emergency support, physiotherapy, regulated dietetic treatment or other professional healthcare.
• Projected timelines, calorie targets, macros, meal plans and training plans are estimates, not guarantees.
• You must review generated recommendations and use reasonable judgement before following them.
• Read the Fitness & AI Disclaimer before beginning or materially changing exercise or nutrition activity.

A coach account may invite clients, apply its own branding, access connected client information, prepare private drafts, publish plans and reviews, and record voice-note feedback. A coach-managed client cannot use FitCheck’s AI controls directly; AI usage and allowances belong to the coach account.

• The coach must have a lawful and appropriate relationship with each invited client and must protect client confidentiality.
• The coach must review, correct and personalise AI-assisted drafts before publishing them.
• The coach is responsible for the professional scope, quality and safety of the coaching they provide through FitCheck.
• The current coach workspace supports up to the client allowance shown at sign-up or in the coach dashboard.
• Either party may end the coaching connection; this does not automatically delete either person’s FitCheck account or records.

Your photos, notes and other content

You keep ownership of information and content you upload. You give us a limited permission to store, process, display and transmit it only as needed to operate FitCheck, provide requested coaching, maintain security and comply with law.

You must have the right to upload the content and must not upload unlawful, abusive, infringing or malicious material. Do not upload another person’s sensitive information or image without an appropriate lawful basis and permission.

Acceptable use

You must not:

• Use FitCheck for unlawful, fraudulent, harmful or abusive activity.
• Attempt to bypass membership restrictions, AI allowances, security controls or administrator permissions.
• Use automated tools to scrape, overload, reverse engineer or interfere with the service.
• Upload malware or content that violates another person’s privacy or intellectual-property rights.
• Present AI output as professional medical advice or use FitCheck to make high-stakes decisions about another person.

Community profiles, leaderboards and friends groups

The FitCheck Community is optional. If you create a community profile, the separate Community Terms & Guidelines also apply and form part of these terms.

You choose a community username, the leaderboard categories you enter and whether you appear on public leaderboards. Joining a private friends group allows its active members to see your selected seven-day community results even when public participation is switched off. Actual weight, private feature details and other private account information are not displayed on leaderboards. Step and most-active scores are subject to daily and seven-day fair-use limits.

You must record genuine activities and measurements, treat other members respectfully, protect private group information and avoid encouraging unsafe weight loss or exercise. We may hide results, remove community access or take proportionate account action where reasonably necessary to address manipulation, harassment, privacy breaches or safety risks.

WHOOP, Strava, MyFitnessPal and other third-party services

Optional integrations are provided by independent organisations and are also governed by their own terms. We are not responsible for their accounts, devices, availability or data accuracy.

You can disconnect supported integrations. Previously imported data may remain in FitCheck until you delete it or ask us to remove it, as explained in the Privacy Policy.

Availability, updates and changes

We aim to keep FitCheck available and secure, but cannot promise uninterrupted or error-free access. Maintenance, hosting issues, provider outages, model limits and circumstances outside reasonable control may affect the service.

We may improve, replace or withdraw features. If a change materially reduces a paid service during an active period, we will take reasonable steps to explain the change and any available remedy.

Suspension, termination and account closure

You may ask us to close your account. We may suspend or close access where reasonably necessary to protect users or the service, investigate serious misuse, comply with law, address non-payment or enforce these terms.

Where practical and lawful, we will explain the reason and give you a reasonable chance to resolve the issue. Information retention and deletion are handled under the Privacy Policy.

Our responsibility to you

We provide FitCheck with reasonable care and skill. We are responsible for foreseeable loss or damage caused by our breach of these terms or failure to use reasonable care, subject to applicable law.

We are not responsible for loss that was not reasonably foreseeable, business loss arising from personal consumer use, or consequences caused by inaccurate information you provide, misuse of the service, ignored warnings or third-party services outside our control.

Nothing excludes or limits responsibility where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, or your statutory consumer rights.

Changes to these terms

We may update these terms to reflect legal, security, commercial or product changes. The latest version will remain publicly available. We will highlight significant changes before they take effect where reasonably possible.

Law and disputes

These terms are governed by the law of England and Wales, but you keep any mandatory consumer protections that apply where you live. Courts with jurisdiction under applicable consumer law may hear disputes.
